This disclaimer is a legal agreement between the user of 'The Pascale Naessens App (hereinafter "user", "you" or "your") and Food & Media (hereinafter "Food & Media", "we", "us" or "our") regarding the use of the Pascale Naessens App ("App")/website. Food & Media provides this App/Website and makes no representations or warranties of any kind, express or implied, as to the availability, accuracy, reliability or content of the App, or any other websites linked to or from this App/Website. Within the limits of what is permitted by applicable laws and regulations, Food & Media shall in no event be liable to the user of the App or any third party with respect to any claim related to the use of or reliance on the App/Website. Food & Media makes no warranty that the App/Website will be uninterrupted or error-free, that any defects will be corrected, or that the App/Website or the server that makes these pages available are free of viruses or other harmful components. Nor is Food & Media responsible or liable for any damage to or viruses that may infect your cell phone or other property as a result of your access to or use of the App/Website.

Pascale Naessens PREMIUM ABONNEMENT

Purchase and cancellation of subscription

Pascale Naessens Premium subscription (hereinafter "Subscription") is offered through the sales platforms Apple App Store and Google Play Store, where you can purchase the Subscription through your Apple or Google account. The amount will be charged to your Apple or Google account when you confirm the purchase of the Subscription.

The terms and conditions of the Apple and Google Play sales platforms apply to your Subscription. The following subscription plans are available:

  • Monthly subscription: subscription with a term of one (1) month. Monthly subscriptions are automatically tacitly renewed for successive periods of one (1) month after the subscription expires, unless you cancel in a timely manner (see below)
  • Annual subscription: subscription with a term of twelve (12) consecutive months. Annual subscriptions are automatically tacitly renewed at the end of the subscription period for consecutive one (1) year periods unless you cancel in a timely manner (continued here).

The renewal is generally charged to your Apple or Google account within 24h before the end of the current subscription period. Your Subscription will be renewed at the same price. If you wish to cancel your Subscription, you must do so directly through the sales platform you used to purchase your Subscription. Please follow the links below for further instructions:

You can manage your Subscription and disable automatic renewal after purchase on the "Manage Subscription" page in your Apple or Google account settings.

A Subscription that has not been cancelled will be automatically renewed and charged by the Apple App Store/Google Play Store unless no payment can be retrieved in your account.

Free trial period

We provide a 7-day free trial period in your Subscription, during which no fee will be charged. According to the terms and conditions of the Apple and Google Play sales platforms, you must timely cancel your Subscription during the trial period if you do not wish to continue using your Subscription. If you do not cancel before the end of the trial period, the Subscription will be charged by the Apple App Store/Google Play Store and your access will remain available until the end of the applicable subscription period. If you cancel early in your trial period, your free trial will run for up to 7 days. You can only use a free trial period once.

Content of the Subscription

Within the Subscription, you as a user will have access to the currently offered recipes and see the preparations of the recipes. The content and features of the Subscription can be changed at any time by Food & Media, which cannot give cause to premature termination of your Subscription.

App content is not medical advice

The content that we provide through the App/Website, including recipes, text, photographs, videos, illustrations, and other materials, whether the content originates from us or third parties (hereinafter, "Content"), is not intended to and should not be construed as or used in lieu of (A) the advice of a physician or other medical professionals, (B) a visit, conversation or consultation with a physician or other medical professionals. The Content does not constitute medical advice. User understands and acknowledges that he/she should never disregard medical advice or fail to seek medical advice because of any content in the App or on the Website, and that he/she should not use the content to diagnose or treat any health problem. The transmission and receipt of the Content, in whole or in part, or communication thereof via the Internet or other means does not constitute an existing doctor-patient, therapist-patient or other health care provider relationship between the App/Website user and Food & Media.

The user understands that Food & Media is not responsible for any health problems that may arise from the use of the App/Website, or from any act or omission of the user, as a result of any information received by the user through the App/Website. The user follows the recipes suggested in the App or through the Website entirely voluntarily and at his/her own risk, and releases and discharges Food & Media from liability for any claims that might arise from the use of the App/Website.

The instructions and advice in the App and on the Website are in no way intended to replace medical guidance.

The limitation of liability set forth in this disclaimer is without prejudice to Food & Media's legal liability for its wilful act or gross negligence or that of its appointees.
